Arbitration

Arbitration is a fast and efficient way of managing and resolving disputes. The process involves the parties to a commercial dispute agreeing to appoint an independent arbitrator, who delivers what is usually a binding decision, known as an award. Most commercial building contracts have an Arbitration Clause which makes it compulsory for disputing parties to enter into arbitration.

There are many commercial reasons which make this method of determination favourable. For one, arbitration is usually a far more cost effective option than litigation primarily because it achieves a relatively speedy outcome. The arbitrator is empowered to make a binding and enforceable decision and is able to award costs.
